1. Preamble and Description of the Service
DrinkMap offers a service allowing users to share the location where they had drinks, track their alcohol consumption, approximately estimate their blood alcohol level and calculate the estimated time needed to become sober again or legally fit to drive. These features are provided for purely informational and social purposes, without any medical or legal claim.
These Terms of Use ("Terms") constitute a legally binding agreement between you ("the User") and DrinkMap ("we", "our", "us", "the application") regarding the use of the DrinkMap mobile application.
2. Limitation of Liability Regarding Blood Alcohol Estimates
2.1 Legal Warning on Blood Alcohol Estimates
The User expressly acknowledges that:
- The blood alcohol calculator only provides an APPROXIMATE ESTIMATE which may differ significantly from your actual blood alcohol level.
- This estimate does not take into account many individual factors such as metabolism, liver function, medication, the amount of food in the stomach and other physiological variables.
- Only a certified breathalyser, an approved electronic breath test or a blood test carried out by a health professional or the police can accurately determine your actual blood alcohol level.
- UNDER NO CIRCUMSTANCES should you use the results provided by DrinkMap to decide whether you are fit to drive a vehicle or to undertake any activity requiring alertness and coordination.
2.2 Approximate Nature of the Calculations
The blood alcohol estimate provided by the application is based on algorithmic calculations taking into account the data declared by the user (weight, gender, consumption). This estimate has no legal or medical value and can in no way replace the use of an approved breathalyser or a blood test.
DrinkMap cannot be held liable for any fraudulent use regarding the age or identity of the User.
2.3 Exclusion of Liability
The application and its developers expressly disclaim all liability for the potential consequences of decisions made by the user on the basis of the estimates provided. In particular, the application does not guarantee that the user is actually fit to drive after the estimated time has elapsed.
2.4 Obligation to Verify
The user acknowledges that it is their responsibility to check their actual condition using approved methods (certified breathalyser) before making any decision that could endanger their safety or that of others, in particular before driving a vehicle.
3. Protection of Personal Data
3.1 Geolocation Data
The application collects and processes the user's geolocation data to enable location sharing. In accordance with privacy regulations, this processing:
- Requires the explicit and informed consent of the user, which can be withdrawn at any time
- Is limited to the stated purpose (social location sharing)
3.2 Health and Personal Data
Data concerning the user's weight, gender and alcohol consumption are considered sensitive data and benefit from enhanced protection:
- This data is stored in encrypted form and is not shared with other users
- It is used solely for the estimation calculations within the application
- It is kept only for as long as necessary to use the service
3.3 User Rights
In accordance with the General Data Protection Regulation (GDPR), the user has the right to access, rectify, erase and port their data, which they can exercise by contacting the publisher of the application using the contact details provided.
4. Legal Warnings About Alcohol
4.1 Health Risks
The user is informed that drinking alcohol carries serious health risks, including liver disease, cardiovascular disorders, cancers and mental health problems.
4.2 Prohibited for Minors
In accordance with the legislation in force, the application is strictly reserved for adults. Any use by a minor is strictly prohibited.
4.3 Promotion of Responsible Drinking
The application aims to encourage moderate and responsible drinking, not to promote excessive consumption. It cannot be held liable for any misuse intended to encourage risky behaviour.
5. Explicit Consent
5.1 Activation of Geolocation
The user expressly consents to the activation of geolocation on their device in order to benefit from the location sharing features. This can be deactivated at any time in the settings of the application or the device.
5.2 Processing of Personal Data
By using the application, the user consents to the processing of their personal data (weight, gender, alcohol consumption) under the conditions described in these terms of use, for the sole purpose of producing blood alcohol estimates.
6. Indemnification and Release of Liability
The user expressly agrees to indemnify and hold harmless the publisher of the application, its directors, employees and partners from any claim, demand, action, cost or expense, including reasonable legal fees, arising from:
- Inappropriate use of the application
- Any decision made on the basis of the estimates provided
- Any breach of these terms of use
7. Changes to the Terms of Use
The publisher reserves the right to modify these terms of use at any time. Users will be informed of substantial changes by a notification in the application. Continued use of the application after modification constitutes acceptance of the new terms.
8. Governing Law and Jurisdiction
These terms are governed by French law. Any dispute relating to the interpretation or performance of these terms shall fall under the exclusive jurisdiction of the competent French courts.
9. Termination
We reserve the right to suspend or terminate your access to DrinkMap, without notice or liability, for any reason, including if we believe that you have breached these Terms.
10. Governing Law and Jurisdiction
These Terms are governed by French law. Any dispute relating to the interpretation or performance of these Terms shall fall under the exclusive jurisdiction of the French courts.
